북한 정권을 찬양하는 이적표현물을 소지했더라도 토토사이트 로그인을 알지 못했다면 처벌할 수 없다는 대법원의 판결이 나왔다.

대법원 1부(주심 민일영 대법관)는 이적표현물을 소지한 혐의(국가보안법 위반) 등으로 기소된 민주노동당 전국학생위원회 전 위원장 이주희(33·여)씨에게 “이적표현물을 갖고 있었더라도 토토사이트 로그인을 인식했다고 볼 수 없으면 국보법 위반으로 처벌할 수 없다”며 무죄를 선고한 원심을 확정했다고 24일 밝혔다.

재판부는 “대학교 운동권 내에서 각종 인쇄물이 광범위하고 다양한 경로로 유통된 점, 압수 당시 가방에 여러 인쇄물이 함께 있었던 점, 인쇄물에 필기·메모·밑줄 등 읽은 흔적을 발견할 수 없는 점 등을 종합해 보면, 이적표현물이 이씨가 인식하지 못한 상태에서 다른 인쇄물과 섞여 가방에 들어갔을 가능성이 있다”고 밝혔다. 이씨는 2003년 11월 경찰에 체포될 때 가방에 ‘동지애, 동지획득’ 등 김일성 우상화와 북한식 공산혁명을 정당화하는 토토사이트 로그인이 담긴 인쇄물을 소지했다는 혐의 등으로 기소됐으나 1·2심에서 무죄가 선고됐다.
